Agency Beat — Terms of Service

1. Agreement

These Terms govern your use of Agency Beat ("the Service"), operated by SME Advantage LLC ("we", "us"). By installing or using the Service you agree to them. If you don't, don't install it.

2. The Service

Agency Beat monitors the availability of URLs and assets you configure and notifies you when they appear to be down, degraded, or recovering. Monitoring is performed on a best-effort, polling basis. It is a tool to help you detect problems — not a guarantee that every outage will be detected or every alert delivered.

3. Access and authorization

You install the Service through your platform's marketplace and authorize it to access your connected account on a read-only basis solely to operate monitoring on your behalf. You are responsible for activity under your account and for keeping your access current.

4. Acceptable use

You may only monitor URLs and assets you own or are authorized to monitor. You may not use the Service to overload, probe, or interfere with systems you don't control, to circumvent access controls, or for any unlawful purpose. We may suspend monitoring that appears abusive.

5. Fees

Fees, if any, for your selected plan are billed through the marketplace through which you installed the Service, on the terms shown there. Plan limits apply per account.

6. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that monitoring will be uninterrupted, timely, accurate, or error-free, that every outage will be detected, or that every alert will be delivered. You remain responsible for the availability of your own assets. The Service is not a substitute for your own operational safeguards.

7. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or special damages, or for any loss arising from undetected downtime, missed or delayed alerts, or reliance on the Service. Our total liability for any claim relating to the Service will not exceed the fees you paid for it in the three months before the claim.

8. Termination

You may stop using the Service at any time by uninstalling it. On uninstall, monitoring stops immediately, our access to that account ends, and we delete the access credentials we hold for it. Your monitoring data is deleted 90 days later; reinstalling within that period restores your monitors and settings. Support correspondence and company contact details are kept for 3 years after the relationship ends, as our own business records — see the Privacy Policy for detail. Fees are handled as described in section 5. We may suspend or terminate access for breach of these Terms.

9. Changes

We may update these Terms; material changes will be reflected by the effective date above. Continued use after a change means you accept it.

10. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.
